Der 8. April 2024 markiert einen Wendepunkt im franz\u00f6sischen Zivilrecht mit der f\u00fcr die Nationalversammlung vorgesehenen Abstimmung \u00fcber die Einf\u00fchrung des Artikels 1253 in das Zivilgesetzbuch. Dieser neue Artikel, der bereits am 3. April die Zustimmung des Senats erhalten hat, formalisiert den Grundsatz der Haftung f\u00fcr Nachbarschaftsst\u00f6rungen, der zuvor durch die Rechtsprechung festgelegt worden war. Er besagt, dass jede Person, die eine St\u00f6rung verursacht, die die normalen Nachbarschaftsbel\u00e4stigungen wie \u00fcberm\u00e4\u00dfige L\u00e4rmbel\u00e4stigung oder Sichtbehinderung \u00fcbersteigt, von Rechts wegen f\u00fcr den entstandenen Schaden haftbar ist.<\/p>

Dieser Artikel 1253 pr\u00e4zisiert, dass diese Haftung nicht gilt, wenn die St\u00f6rung aus Aktivit\u00e4ten resultiert, die vor der Ansiedlung des Kl\u00e4gers stattfanden, den Vorschriften entsprachen und die Bedingungen nicht so ver\u00e4ndert haben, dass die St\u00f6rung verschlimmert wird. Diese Bestimmung hebt Artikel 113-8 des Bau- und Wohnungsgesetzbuches auf und f\u00fchrt \u00c4nderungen in das l\u00e4ndliche Gesetzbuch ein, um Landwirtschaftsaktivit\u00e4ten spezifische Ausnahmen zu gew\u00e4hren.<\/p>
